Terms and conditions
The basics
‘The client’ or ‘you/your’ refers to the individual, company or organisation that contracts Scott Moffatt to provide professional services.
‘I’ refers to Scott Moffatt or my subcontractors.
Fees payable
My hourly rate is $77.00. I will provide an estimated project cost and work within this budget subject to the provisions in Design and development process below.
Upon acceptance of the design specification/proposal the client agrees to pay Scott Moffatt 50% of the agreed estimated project cost. The remaining 50% is payable upon completion of the project.
The project deliverables (website, e-learning system, training materials, help system etc.) remain the property of Scott Moffatt until final payment is received.
Design and development process
The initial meeting/consultation along with this proposal aims to accurately define your needs and agree a design strategy.
Project timeframes and estimated costs are based on our initial discussions and the assumptions contained in the design proposal. I reserve the right (but will always consult with you first) to extend the project timeframe and/or cost estimate in the event of:
- requests for design revisions beyond a reasonable number (typically 3)
- lack of feedback or timely provision of feedback
- delays in the provision of content
- inclusion of content and/or functionality that significantly exceeds that described in the design specification.
Intellectual property and copyright
The intellectual property and copyright of the project deliverables, e.g. website and graphics passes to the client on final project payment.
You must own the copyright for, or rights to, any content you provide to me for inclusion in the deliverable. I accept no liability arising from content provided by clients that infringes the copyright of another.
Copyright to certain content such as stock images and functionality such as themes, frameworks, custom code, scripts, etc. may be retained by the original author as part of a licence agreement. I will inform you of any such items during the development of your project.
I am not responsible for copyright infringements arising from graphics and copy supplied by the client. You must ensure that you have permission to use such material.
